Domain Services Terms

These Domain Services Terms apply to every domain name you buy, renew or manage through LevelUpGrowth. They form part of our Terms of Service. LevelUpGrowth is operated by Level Up Growth FZE LLC, a Free Zone Entity licensed by the Ajman Nuventures Centre (ANC) Free Zone, Government of Ajman, United Arab Emirates (licence no. 2629521929888), registered at BC-894540, 26th Floor, Amber Gem Tower, Ajman, United Arab Emirates. In these terms, “we” and “us” mean Level Up Growth FZE LLC, and “you” means the customer whose account the domain was bought from. You accept these terms when you tick “I agree to the Domain Services Terms” at checkout.

1. How your domain is registered

1.1 When you buy a domain through LevelUpGrowth, Level Up Growth FZE LLC registers it in its own name as the registrant of record, through our ICANN-accredited registrar partner.

1.2 We hold the domain on your behalf. While your account is active and the domain is paid for, you have the exclusive right to use it and to decide where it points, for example your website or your email. Our records name you, your business and your account as the party the domain is held for.

1.3 Holding the domain in our name lets us manage renewals, security and technical settings for you without interruption.

1.4 Where the domain extension supports it, we switch on free WHOIS privacy, so the public WHOIS record shows a privacy service rather than contact details.

2. Your right to take the domain with you

2.1 You can ask us at any time to transfer the domain to you or to another provider, using “Transfer this domain to me / another provider” on the domain’s page in your account, or by writing to [email protected]. We will start the transfer within 5 business days of a valid request.

2.2 We can transfer the domain when:

• (a) all fees for the domain and any related services are paid;
• (b) the domain is not subject to an open abuse complaint, dispute, court order or legal hold; and
• (c) registry and registrar rules allow it. Some rules lock a domain for a time, for example for 60 days after it is registered, transferred, or after the owner details change. If that applies, we tell you the date the lock ends.

2.3 We do not charge a fee to hand over a domain. Any fee charged by the receiving provider is yours.

2.4 If we stop offering domain services or stop trading, we will offer every customer the transfer of their domain at no charge before we stop.

3. Renewal, non-payment and expiry

3.1 A domain is registered for the term you paid for. You can switch automatic renewal on or off from the domain’s page, and we remind you before a domain is due to renew or expire.

3.2 If a renewal payment fails, we keep the domain active for a grace period of 14 days and remind you. After the grace period we may stop renewing the domain.

3.3 A domain that is not renewed can expire, be suspended by the registry, and eventually become available to others. Recovering a domain after it expires may cost extra and is not guaranteed.

3.4 Domain registrations and renewals are non-refundable once they are submitted to the registry, because the registry fee cannot be recovered. If a registration fails on our side, we refund what you paid for it. Our Refunds and Billing policy applies to everything else.

4. Acceptable use

4.1 You must not use the domain, or let it be used, for anything unlawful or harmful, including fraud or phishing, malware, spam, infringing someone’s trademark or copyright, impersonation, illegal content, or anything prohibited by the laws of the United Arab Emirates or the rules of the domain’s registry. Our Abuse Policy explains how we handle reports.

4.2 You are responsible for everything published, sent or hosted using the domain.

4.3 If we receive a credible complaint, or a request from a registry, registrar, court or authority, we may suspend, redirect or lock the domain without notice, and we will tell you as soon as we can.

5. Disclosure of your identity

5.1 Because we are the registrant of record and you are the user of the domain, ICANN rules make the registrant responsible for harm caused by wrongful use of the domain unless it discloses the user’s identity and contact details when someone provides reasonable evidence of actionable harm.

5.2 You agree that we may disclose your identity and contact details to such a party, to a dispute-resolution provider, a court, the registry or registrar, or law enforcement, within the time ICANN rules require (currently 7 days), without further notice to you.

6. Disputes over the domain name

6.1 You agree to be bound by the Uniform Domain-Name Dispute-Resolution Policy (UDRP) and any dispute policy of the relevant registry.

6.2 If a dispute is brought against the domain, you will cooperate fully. We may act on any decision of a dispute provider or court, including transferring or cancelling the domain.

7. Your indemnity

7.1 You will indemnify and hold harmless Level Up Growth FZE LLC, its officers and staff against any claim, loss, fine, cost or legal fee arising from your use of the domain, its content, or any breach of these terms, including claims that name us because we are the registrant of record.

8. Accuracy of your details

8.1 You must keep your account details accurate and up to date. We rely on them to contact you and for disclosure under section 5.

9. Registry and registrar rules

9.1 Each domain is subject to the policies of its registry, the rules of our registrar partner and ICANN policies, as updated from time to time. Where they conflict with these terms, those policies prevail for that domain.

9.2 Some domain extensions, for example country domains such as .ae, have extra eligibility rules. We tell you before purchase if a domain needs extra documents.

10. Limits of our responsibility

10.1 We do not guarantee that a domain is available until its registration is confirmed, or that a registry will not change its prices or rules.

10.2 Our total liability for domain services is limited to the fees you paid us for the affected domain in the 12 months before the claim. We are not liable for indirect loss, lost profit or lost business. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law.

11. Changes to these terms

11.1 We may update these terms. Each version is dated; the version you accepted is recorded with your order. A change applies to a domain from its next registration, renewal or transfer, and we will tell you about any material change before it applies.

12. Governing law and disputes

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Ajman, and the courts of Ajman have jurisdiction over any dispute arising from them.
